Refund Policy

Our refund policy is designed to ensure customer satisfaction.

1. Sale of Equipment

​

These Terms and Conditions shall apply and be binding on every purchaser of Equipment from Aura Medical (each a “Customer”) pursuant to any purchase order or other document (“Order”) Each Order signed on behalf of Customer will be deemed to be an offer by Customer to

purchase the Equipment upon these Terms and Conditions and at the price specified in the Order. A contract shall be formed on the basis of these terms and conditions if Customers Order is accepted in writing by Aura Medical; otherwise no contract is or shall be deemed

to be formed.

2. Acceptance of Equipment, Inspection and Cancellation

​

Acceptance of Equipment purchased by Customer shall occur on receipt of the Equipment or any portion thereof. Within seven days of acceptance, Customer shall inspect the Equipment, read the accompanying documentation and give written notice of any error or. claim that the Equipment does not conform to the Order. Partial Shipment by Aura Medical is not a basis for a non-conformity claim. Orders may not be cancelled after shipment and Equipment may not be returned without Aura Medical prior written consent. If Customer wishes to terminate or amend an Order, prior to shipment, Aura Medical may, but shall not be obliged to, cancel or change the Order subject to Customer paying Aura Medical any anticipated losses on cancellation (including loss of profit) or increase in price.

3. Price of Equipment

​

By submitting an Order, Customer agrees to pay the price specified in the Order. Customer accepts that any quotation given to it does not amount to a contractual offer and is only an indication that Supplier may be willing to supply Equipment at a price. In any event, no

quotation is to be regarded as valid after 60 days of its issue. For the avoidance of doubt, no price specified in a quotation or Order includes VAT or other applicable taxes or duties or the cost of delivery, unless otherwise specifically stated.

4. Taxes and Other Charges

​

Customer is responsible for all taxes relating to the purchase of the Equipment, including but not limited to all sales, VAT, import, customs, duties and any other taxes imposed at the current prevailing rate.

5. Delivery

​

The parties will agree the most appropriate delivery method prior to Shipment. If Aura Medical use a third party carrier to deliver the Equipment, Aura Medical shall be liable for damage or any shortfall in supply up to the point of delivery (but not for any consequential loss) provided that:

​

(a) the damage or shortfall is notified to Aura Medical and to the carrier (in writing) within three days of the delivery: (b) the Equipment has been signed for as not examined; and (c) Customer has handled the Equipment in accordance with the carriers conditions; or if the goods

have not been delivered at all, Customer notifies Aura Medical and the carrier (in writing) within three days after the scheduled delivery date. Unless Customer informs Aura Medical otherwise within three days of receipt of the Equipment, Customer will be taken to have

accepted all the Equipment received in that Order. All delivery dates are approximate. Aura Medical will use reasonable endeavours to meet agreed delivery dates but accepts no liability for failure to deliver on time, and the time and date of delivery shall not be of the essence. Aura Medical will deliver in one shipment when possible but reserves the right to

make delivery in installments.

6. Payment

​

Any deposits paid are non-refundable. Customer shall pay Aura Medical the price specified in the Order, as well as any VAT which may apply and any delivery costs, within 30 days of the date written on the Order, or earlier if so agreed in an Order. If Customer fails to pay the whole or part of any sums owed to Aura Medical by the relevant due date, all sums owed toAura Medical will become payable immediately and Aura Medical may issue court proceedings to recover any outstanding sums without giving Customer notice. Customer may

not set -off or deduct anything from the outstanding sums without Aura Medical written consent. If any sum is not paid when due, Customer shall pay interest on that sum at the rate of 4% above the Bank of England base rate, compounded on the first of each month, for each day

that payment remains outstanding and Aura Medical will be entitled to suspend delivery of or cancel any outstanding Orders.

7. Installation and On-Site Repair

​

The price specified in the Order does not, unless otherwise stated, include the cost of installation and servicing of the Equipment. If Aura Medical agrees to install or service or repair any Equipment at a place specified by Customer (the “Area”), Customer will:

(a) be responsible for ensuring that all surfaces in the Area to which the Equipment may be affixed are in good condition; (b) provide Aura Medical with a safe suitable electrical supply to the Area; (c) give the Aura Medical employees and/or contractors unrestricted access to the Area; (d) make sure that the Area is safe; (e ) provide Aura Medical employees and/or contractors with such services as are necessary or reasonably requested; and (f) be available to let Aura Medical employees and/or contractors in to the Area at the agreed time. If Aura Medical cannot carry out the installation, servicing or repair or if it takes longer than usual because Customer has failed to satisfy any of its responsibilities in this Clause, Aura Medical may charge Customer for any time and additional expense or other losses, including loss of profit, incurred as a result.
